Terms of Service

1. Acceptance of Terms

By accessing or using the Oxer platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Seller accounts require identity verification and a connected Stripe account.

3. Bidding Obligations

All bids placed on the Platform are legally binding offers to purchase. By placing a bid, you agree to complete the purchase at the bid price if you are the winning bidder. Bid retraction is not permitted once placed. Anti-snipe protection may extend auction end times.

4. Payment Terms

Winning bidders must complete payment within 48 hours of the auction ending. Payments are processed through Stripe and held in escrow until delivery is confirmed. A buyer's premium may apply to the final sale price. Failure to complete payment may result in account suspension.

5. Seller Responsibilities

Sellers must provide accurate and complete descriptions of horses listed for auction, including health records, competition history, and any known issues. Sellers must complete identity verification and maintain a connected Stripe account for payouts. Misrepresentation of a horse's condition or history may result in account termination and legal action.

6. Buyer Responsibilities

Buyers are responsible for conducting their own due diligence before bidding, including arranging pre-purchase veterinary examinations where appropriate. Buyers must arrange and pay for transportation of purchased horses. All sales are final once delivery is confirmed.

7. Dispute Resolution

In the event of a dispute between buyer and seller, either party may file a dispute through the Platform within 7 days of delivery confirmation. Oxer will review disputes and may mediate a resolution. Our dispute resolution decision is final and binding. Refunds, when issued, will be processed through the original payment method.

8. Platform Fees

Oxer charges a commission on completed sales. The fee structure is disclosed to sellers during the listing process and to buyers before bidding. Platform fees are non-refundable except at Oxer's sole discretion.

9. Prohibited Conduct

You may not: engage in shill bidding or bid manipulation; create multiple accounts to circumvent restrictions; harass other users; post false or misleading information; use automated tools to place bids; or engage in any activity that undermines the integrity of the auction process.

10. Limitation of Liability

Oxer acts as a marketplace facilitator and is not a party to transactions between buyers and sellers. To the maximum extent permitted by law, Oxer shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to the condition of horses purchased, transportation issues, or disputes between users.

11. Intellectual Property

All content on the Platform, including logos, designs, and software, is owned by Oxer or its licensors. By uploading content (photos, descriptions, etc.), you grant Oxer a non-exclusive, worldwide license to use that content in connection with the Platform.

12. Termination

Oxer reserves the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, any pending transactions will be handled on a case-by-case basis.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law provisions. Any legal action arising from these Terms shall be brought in the courts located in New York, NY.
